Terms and contions

CONDITIONS

a) Minimum rental
One day (part of the day, either at the start or end of the rental, is considered a rental day in each case).

b) Age (minimum)
23 years with at least 1 year of driver´s license.

c) Cancellations
For confirmed rentals, cancellations must be made at least 3 days before the pick-up date.

d) Bookings
The rental terms, delivery and collection dates, etc., are binding.

e) Payment
The minimum deductible is stated on the local cost of renting days and extra fees.

f) Documents and equipment
The car is delivered with sealed speedometer. Normal tools, one spare wheel or repair kit, five tires duly marked and without visible defects and car license.

g) Maintenance
The client is responsible for the good use and maintenance of the car and undertakes, moreover, to check the oil, the battery, the tires, the water level at the radiator, etc.

h) Return of the car
The rental ends on the stipulated drop-off date on the contract. If the client wishes to change the drop-off date, they should inform the company with duly notice. The vehicle should be dropped off in the same conditions as delivered, apart from normal wear.

i) Damages
Damages in the car not caused by a normal wear is the responsibility of the driver. Any damage caused by shock at the inferior part of the vehicle, aluminum wheel and drain plugs will be the responsibility of the customer.

j) Accidents
In case of accidents, the client must inform the rental Firm by telephone, confirm it by letter within 24 hours and have the case immediately investigated by competent authorities.

k) General Rules
The client is obliged to use the car personally and to respect the laws in the countries where he is travelling.

l) Paid by the renter
Petrol, garaging and washing during rental period. All fines during rental.

m) Insurance:
The rental price includes unlimited coverage of public liability until agreed amount.

n) Collision Damage Waiver (CDW):
The renter is responsible for any damage caused to the Drive Terceira Rent vehicle as the result of an accident. Deductible is set at 2300€
The Renter may accept the Collision Damage Waiver (CDW) Clause by paying an additional charge, in which case he will only be liable up to the minimum excess amount for damage to the vehicle. However, even if the Renter accepts the CDW Clause, he is always liable for any accidents occurring in situations involving intent or serious negligence such as driving under the influence of alcohol, narcotics or any other substances affecting his capacity for reaction as well as in case of serious breaches of the Highway Code and supplementary legislation in force.

o) Thief, Fire or Acts of Vandalism – (TP):
In the event of the theft of a Drive Terceira Rent vehicle or of parts thereof, fire or acts of vandalism, the Renter shall be responsible for all damages caused.
The Renter may accept the Theft Protection (TP) Clause by paying an additional charge, in which case he is no longer obliged to pay for all damages over and above the minimum excess.
Even if the Renter has subscribed to the TP Clause, he is always liable for damages resulting from situations involving the misuse or misappropriation of the Drive Terceira rent vehicle, its usage by an unauthorized additional driver and whenever the Renter acts with intent or serious negligence, such as leaving the vehicle with the key in the ignition and/or the doors or windows opened.

p) Super CDW (SCDW):
The client that acquires the Super CDW, CDW, TP and WDW will be reducing the value of the obligatory deductible to a maximum of 150€.

q) (WDW) – Windscreen Damage Waiver:
This coverage is subjected to the SCDW insurance if the damage doesn´t come from negligence or misuse.

r) Road assistance
(flat tires, no battery, lack of fuel, keys inside the vehicle or lost) – €3/day. If assistance is requested without it having been added, a fee of €55 is applied.

s) Honest Damage and overall condition of the vehicle recognition through Drive Terceira:
Drive Terceira’s damage recognition is made in an honest and efficient manner. Upon the vehicle´s pick-up, a detailed registry is made by a collaborator of Drive Terceira, with the client present, using a video and photography system that captures the vehicle in all the relevant angles. This system helps to avoid doubts about the vehicles condition, assuring that the renter and the company agree on the initial condition of the vehicle, bringing safety and tranquility through the renting period. These images and details will be registered manually by Drive Terceira collaborator in this contract. If the client drops off the car and does not stay for the vehicle condition review, then the client accepts the condition as detailed by the Drive Terceira collaborator.

t) Fuel at drop-off:
The renter must return the vehicle with the same amount of fuel as it was upon the pick-up. If not, the renter will be charged a fixed fee of 80€ + V.A.T to replace amount of fuel needed to replace the initial condition of the fuel tank.

Vehicles drop-off “check-in”:
The vehicles drop-off “check-in” should always be done by the renter and Drive Terceira collaborator, at the previously agreed time. If this doesn´t happen, the renter will be fully responsible for all damages the vehicle presents, regardless of having acquired the CDW, SCDW, TP or TGL coverages.
Damages to the vehicle:
Minor damages caused to the vehicle, that don´t compromise it´s return to the rental firm and use compliant with the Road Legislation, are charged according to the pricing made by Drive Terceira´s auto workshop: Recommended pricing for small damages, including the costs of the vehicle´s immobilization as well as administrative costs associated with managing the damages. Any other more severe damages that don´t allow the vehicle´s return to the rental firm and require it´s temporary immobilization to repair, will be evaluated by an expert from Drive Terceira´s workshop and charged according to the resulting report. In addition to the full payment of the repair budget, the client will be charged with the temporary immobilization of the vehicle according to the daily rate of rental, at the time.

IMPORTANT WARNING:
The rental period ends the day previously agreed on by the client and the Drive Terceira Rent’s collaborator, at the time of pick-up. If the client wishes to extend the rental period, he must communicate it to the rental company and proceed with the resulting payment. If this doesn´t happen, we will consider the car as missing and proceed with the communication to the authorities. The fines and penalties resulting from this infraction will be the client´s responsibility.
The present text reflects the Drive Terceira Standard Terms and Conditions. It seeks to inform the Renter of the procedures to be adopted in the event of an accident, theft, fire or acts of vandalism. It does not exclude the reading of the Drive Terceira Standard Terms and Conditions which are obligatory to read.
Failure to comply with these obligations shall be the sole responsibility of the renter, even if the latter has subscribed to CDW (Collision Damage Waiver), SCDW (DE – Deductible Exemption), TGL (Tires, Glass, Locks) and/or TP (Theft Protection) clauses.
